1. Acceptance of Terms

By creating an account, browsing listings, or using any services on Carsooq, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, along with our Privacy Policy.

These terms constitute a legally binding agreement between you and Carsooq. If you are using our services on behalf of a business or organization, you represent that you have the authority to bind that entity to these terms.

We reserve the right to modify these terms at any time. Your continued use of our services after any changes indicates your acceptance of the modified terms.

2. User Accounts

2.1 Account Registration

To access certain features of Carsooq, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Be at least 18 years old or the legal age of majority in your jurisdiction

2.2 Account Responsibility

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security. You may not transfer or share your account with others.

2.3 Account Types

Carsooq offers different account types including individual buyers, individual sellers, and dealer accounts. Different terms and features may apply to each account type. Dealers must provide valid business registration and licensing documentation.

3. Listing Vehicles

3.1 Listing Requirements

When listing a vehicle for sale on Carsooq, you agree to:

• Provide accurate and truthful information about the vehicle
• Have the legal right to sell the vehicle
• Upload clear, authentic photos of the actual vehicle
• Disclose any known defects, damages, or issues
• Provide accurate mileage, service history, and accident history
• Set fair and honest pricing
• Comply with all applicable laws regarding vehicle sales

3.2 Listing Restrictions

You may not list vehicles that are:

• Stolen or have questionable ownership
• Subject to liens or encumbrances without disclosure
• Salvage or rebuilt without clear disclosure
• Modified in ways that violate safety or emissions regulations
• Advertised with misleading or false information

3.3 Content Rights

By posting a listing, you grant Carsooq a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your listing content for the purpose of operating and promoting our platform.

3.4 Listing Management

Carsooq reserves the right to remove, modify, or refuse any listing that violates these terms, applicable laws, or our community standards. We may also remove inactive listings after a specified period.

4. Buying Vehicles

4.1 Marketplace Role

Carsooq is a marketplace platform that connects buyers and sellers. We do not own, sell, or guarantee any vehicles listed on our platform. All transactions are conducted directly between buyers and sellers.

4.2 Buyer Responsibilities

As a buyer, you agree to:

• Conduct your own due diligence on any vehicle
• Inspect vehicles in person before purchasing
• Verify all information provided by sellers
• Obtain independent inspections when appropriate
• Verify ownership and title status
• Complete all necessary legal and financial transactions
• Comply with all applicable vehicle registration and taxation laws

4.3 No Warranties

Carsooq does not provide any warranties or guarantees regarding vehicles listed on our platform. All vehicles are sold "as is" unless otherwise stated by the seller. We are not responsible for the condition, quality, safety, or legality of any vehicle.

4.4 Payment and Transactions

All payment arrangements are made directly between buyers and sellers. Carsooq is not involved in payment processing or financial transactions. We strongly recommend using secure payment methods and avoiding cash transactions for large amounts.

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Posting false, misleading, or deceptive listings
• Engaging in fraudulent activities or scams
• Listing stolen vehicles or vehicles with fraudulent documentation
• Manipulating odometer readings or vehicle history
• Impersonating another person or entity
• Harassing, threatening, or abusing other users
• Circumventing our platform to conduct transactions externally to avoid fees
• Scraping, data mining, or using automated tools to access our platform
• Uploading viruses, malware, or harmful code
• Violating any applicable laws or regulations
• Infringing on intellectual property rights of others
• Creating multiple accounts to manipulate our system
• Posting spam, advertisements, or unsolicited commercial content

Violation of these prohibitions may result in immediate account termination and legal action.

6. Intellectual Property

6.1 Carsooq Property

All content on Carsooq, including but not limited to text, graphics, logos, icons, images, software, and design elements, are the property of Carsooq or its licensors and are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to access and use our platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

6.3 User Content

You retain ownership of content you post on Carsooq, but you grant us the rights described in Section 3.3. You represent and warrant that you own or have the necessary rights to post your content and that it does not infringe on any third-party rights.

6.4 Trademarks

The Carsooq name, logo, and related marks are trademarks of Carsooq. You may not use these trademarks without our prior written consent. Other trademarks appearing on our platform are the property of their respective owners.

7. Limitation of Liability

7.1 Platform "As Is"

Our platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation of our platform or the information, content, or materials included on it.

7.2 No Liability for User Actions

Carsooq is not liable for any actions, conduct, or content of users. We do not guarantee the accuracy of listings, the quality of vehicles, or the reliability of users. You use our platform at your own risk.

7.3 Limitation of Damages

To the maximum extent permitted by law, Carsooq shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of our platform.

7.4 Maximum Liability

In no event shall our total liability to you for all claims exceed the amount you paid us in the twelve months preceding the claim, or $100 USD, whichever is greater.

7.5 Jurisdictional Limitations

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Carsooq, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of our platform
• Your violation of these Terms and Conditions
• Your violation of any rights of another party
• Your listings, content, or communications on our platform
• Any transactions you conduct through our platform
• Your violation of any applicable laws or regulations

This indemnification obligation will survive the termination of these terms and your use of our platform.

9. Termination

9.1 Termination by You

You may terminate your account at any time by contacting our support team or using the account deletion feature in your account settings. Upon termination, your listings will be removed and your account data will be processed according to our Privacy Policy.

9.2 Termination by Carsooq

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms and Conditions
• Fraudulent or illegal activities
• Complaints from other users
• Extended periods of inactivity
• Requests from law enforcement or regulatory authorities

9.3 Effect of Termination

Upon termination, your right to use our platform will immediately cease. We may delete your account and content, though we may retain certain information as required by law or for legitimate business purposes. Sections of these terms that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions.

Any disputes arising from these terms or your use of our platform shall be subject to the exclusive jurisdiction of the courts located in Dubai, United Arab Emirates.

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

11. Changes to Terms

We reserve the right to modify or update these Terms and Conditions at any time. When we make changes, we will update the "Last updated" date at the top of this page.

We will notify you of material changes by posting a notice on our platform or sending an email to your registered email address. Your continued use of our platform after such notification constitutes your acceptance of the modified terms.
